Woodman Asset Management AG and its affiliates (“Woodman” or “we”) provide its content on this website (the “Site”) subject to the following terms and conditions (the “Terms”), which may be updated from time to time without further notice. By accessing and using this Site, you agree to abide by and be legally bound by these Terms.

1 Local Restrictions

Not all services and materials described on this Site are eligible for sale or available for use in all jurisdictions or to certain categories of investors. Investment Distribution in the European Union and EFTA

Woodman Asset Management AG itself does not provide any investment services within the European Union or the European Free Trade Association. Woodman Europe GmbH is a subsidiary of Woodman Asset Management AG and responsible for the distribution of financial instruments in Germany and within the European Economic Area (“EEA”). Woodman Europe GmbH provides its services in investment brokerage and investment advice in financial instruments within the meaning of Section 2 [2] No. 3 and 4 of the German Securities Institutions Act (“WpIG”) as a contractually tied agent pursuant to Section 3 [2] WpIG exclusively for the account and under the liability of AHP Capital Management GmbH (“AHP”), Weissfrauenstrasse 12–16, 60311 Frankfurt am Main, Germany. As a tied agent of AHP Woodman Europe GmbH is allowed to provide services concerning AHP’s investment brokerage and investment solicitation in regard to financial instruments in Germany and it is intended to expand these activities into other EU and EFTA member states.

AHP is authorized and regulated in Germany by the German Federal Financial Supervisory Authority (Bundesanstalt für Finanzdienstleistungsaufsicht, BaFin). In accordance with the legal requirements, AHP is obliged to inform its clients of the following information about AHP Capital Management GmbH and its investment services: MiFID Information.

As a convenience, the Site may provide third party content and links to third party websites, e.g., in instances of framing of third party websites or incorporation through framesets of content supplied by third party servers. Woodman has no control over and no responsibility for third party websites and its content, which are governed by the terms and policies, if any, of respective third party content provider.

All content and functionality on the Site are provided "as is”. Woodman makes no representations or warranties of any kind, either express or implied, including, without limitation, warranties with respect to merchantability, fitness for a particular purpose, ownership, accuracy, timeliness, completeness or availability of the Site. Woodman is under no obligation to update the information and opinions contained herein. Woodman or its affiliates, directors and employees shall not be liable for any direct, indirect, incidental or consequential loss, cost, claim, expense or damages of any kind or for lost revenues or lost profits, whether or not advised of the possibility of such damages, whether in contract or in tort. No responsibility or liability is borne by Woodman with respect to any information published on linked web sites, contained in any user submissions, provided by third parties or based on the use of social bookmarks.

7 Notice of Infringement

Woodman prohibits the posting of any information that infringes or violates any intellectual property rights of any person or entity. If you believe that your intellectual property right is infringed by any content on the Site, please immediately inform Woodman with a written statement. Woodman will remove any posted submission that infringes intellectual property right of any person under Swiss law upon review of such statement, if held justified.

8 Governing Law; Jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding principles of conflict of laws. Place of jurisdiction is Zug (ZG), Switzerland.
